Premises 

The offer and sale of products are governed by the following general conditions of sale.
The purchased products are sold by Cupelli spumanti soc. simple agricultural 

Definitions:
The following definitions are used in this agreement 

Customer: indicates the natural person or legal entity who purchases the products 

Supplier: indicates the company Cupelli spumanti soc. simple agricultural 

Products: indicates the products marketed by Cupelli spumanti soc. simple agricultural 

Set off: indicates the Customer and/or Cupelli spumanti soc. simple agricultural 

Knowledge of the General Conditions of Sale 

The conditions of sale are considered known by the customer at the time of execution of the purchase. Therefore each order implies the implicit acceptance. These conditions  general terms can be updated or modified at any time by the Supplier who will communicate them through the appropriate communication channels to customers. 

Object of the contract 

The offer and sale of products imply the implementation of a distance contract governed by the articles 50 ff. of Legislative Decree 6 September 2005, n. 206 (Consumer Code), as well as from Legislative Decree 9 April 2003 n. 70 (so-called Electronic Commerce Law). 

Acceptance of the Order and Conclusion of the Sales Contract 

The Customer, by sending a purchase order, declares to know and accept these conditions of sale and the additional information contained on the site. The contract will be considered concluded, and will be binding for both parties, only when it is sent to the Customer, by e-mail to the e-mail address indicated at the time of purchase, the order confirmation notice. 

Products and Sale Prices 

All sales prices of the products shown are inclusive of VAT and all other taxes. It is understood that the image accompanying the presentation of the products may not be perfectly representative of its characteristics but may differ in colour, size and accessory products present in the figure. 

Terms of payment 

At the time of purchase, the customer can choose whether to pay by credit card, account PayPal. For payment by credit card or PayPal account, the customer will be redirected on the PayPal payment platform, where you can make the payment in secure mode. There PayPal platform directly manages the data entered on its website to carry out the payment. The Supplier does not collect any data relating to the Credit Card used, or related to the access codes to the "PayPal" form of payment. This information is collected directly from the PayPal payment system. 

Tax Certification and Invoice 

In any case, all customers will be sent an order summary. The related tax receipt/receipt to products purchased by private individuals will be regularly issued. For VAT holders, please instead of sending their company data in case they need the issuance of the invoice to following email info@cupellivini.com 

Delivery terms and conditions 

The products are shipped by express courier, and delivery times to the customer vary function of the destination, the moment in which the order is acquired and the availability of the product itself. In any case, however, delivery times will never exceed those foreseen by art. 6 Legislative Decree 185/99. Delivery to the courier takes place within 3 working days from the moment of sending the order confirmation to the customer. Barring unforeseen delivery times in the area national will be equal to 1 working day from delivery to the Courier. For Puglia, Basilicata Calabria, Sicily and Sardinia, delivery times will generally be 2 days working. For places that are difficult to reach such as mountain resorts, smaller islands, extremes suburbs, delivery times will be 3/4 working days. Upon receipt of the goods, the Customer must strictly verify that the package is perfectly closed, intact and not damaged. A guarantee adhesive tape is applied to each package to prevent it from being opened and to signal any attempts at tampering if the tape is damaged. In the event that the warranty tape is damaged, the Customer must immediately report the fact to the courier, accepting the package with specific reserve indicating where and how the package was damaged. Otherwise, the package will be deemed duly delivered. If the customer is not available at the time of delivery of the order, the courier will leave a notice indicating the address of the closest UPS access point if present in the area, where the package can be collected by the recipient, presenting the code QR code which will be shown on the notice, within 10 days of the filing date. If there is no access point near the place of delivery, in this case the courier will make two more delivery attempts. In order to be able to carry out the delivery without impediments, the Customer is asked to enter a mobile phone number in the delivery data. 

Shipping cost 

A minimum order is not required for shipping, a contribution of 15.00 euros is required for transport and shipping costs. The possibility of obtaining free shipping of the order is offered in the case of an order exceeding 100.00 euros of expenditure. Otherwise, communication will be given directly on the site and in the order summary, before the purchase. 

Right of withdrawal 

Pursuant to and for the purposes of the Consumer Code, Legislative Decree 206/2005 and Legislative Decree 21/2014, the Customer you are given the right to exercise the right of withdrawal, without any penalty and without specifying the reason, within 14 calendar days from the date of receipt of the purchased good. To exercise this right, the Customer must send, within the terms indicated, a simple e-mail to the address info@cupellivini.com in which their data are indicated, namely Name, Surname, Address, Order Number, telephone, product description, IBAN code and current account holder where you are asked to make the transfer for the refund (see email template below). As soon as once this request has been confirmed by the Supplier, the Customer must return, at his own expense and with a courier of your choice, the product you intend to return, including in the shipment a letter with your data communicated via e-mail (see model below). The returned product must reach the Supplier within a maximum of 14 calendar days from the date on which he communicated the withdrawal. Once the returned product has been received, the Supplier will proceed, by bank transfer, to the refund relating to the price paid for the product/products for which the right to was exercised withdrawal, within 14 calendar days. The customer will be held responsible, and therefore not refundable, for the decrease in value of the goods resulting from a different handling than that strictly necessary to establish the nature and characteristics of the goods. For products for personal use, for hygienic and sanitary reasons it is not possible to return products that have already been used. All risks relating to the transport of the returned product are the responsibility of the Customer. 

To facilitate the Customer in exercising the right of withdrawal, here is an example of communication 

e-mail, to be included in the package with which the returned product is shipped:
Subject: return communication
Order Number: (indicate the order number with which the goods were purchased).
Buyer data: (indicate name, surname, address, telephone, e-mail)
Product for which the right of withdrawal is exercised: (indicate the brand, name and format of the product, any product code as per the order summary sent in the shipment)
IBAN code: (indicate the IBAN number of the current account where you intend to receive refund credit)
Current Account Holder: (Indicate the holder of the current account at which it is intended receive the refund credit). 

Provision and Processing of Personal Data 

The Customer's personal data is collected for the purpose of being able to execute the contract purchase and shipment of orders received. These data are processed electronically in compliance of the laws in force and may be exhibited only at the request of the judicial authority or of other authorities authorized by law. Personal data will be communicated to delegated subjects to carry out the activities necessary for the execution of the stipulated and disseminated contract exclusively for this purpose. The Customer expressly undertakes to procure the Supplier copy of the identity documents deemed necessary for the purpose of any checks. 

Failure to comply with the aforementioned request authorizes the Supplier to immediately terminate the contract due to non-fulfilment. The treatment takes place, also with the aid of electronic means, in compliance with the methods that the art. 5 GDPR guarantees the user and, in general, protecting his rights, fundamental freedoms and dignity, with particular reference to privacy and personal identity. The processing will take place for a period of time not exceeding that strictly necessary for the fulfillment of the purposes described above. Obtaining the cancellation of personal data is subject to sending a written communication sent to the Supplier. 

Applicable Law and Competent Court 

The contract between Cupelli spumanti soc. simple agricultural and the customer is governed by Italian law. For any dispute between the parties regarding this contract the Court of Pisa will be competent
